DCS does not solicit, encourage, or facilitate the filing of an insurance claim absent a covered loss, and does not offer monetary advances, loans, gifts, or any inducement valued above $25 to obtain a contract (Fla. Stat. §626.854). Hiring a public adjuster is optional. You do not have to enter into a contract with a public adjuster to make a claim for loss or damage on a policy of insurance. Public adjuster fees in Texas are capped at 10% of the insurance settlement under Texas Insurance Code Chapter 4102. Public adjuster fees in Florida are capped at 10% on claims tied to a Governor-declared state of emergency (for one year after the declaration) and 20% on non-emergency claims under Florida Statute §626.854.
